Notices Sent to Black Elk and Contractors
The Bureau of Safety and Environmental Enforcement (BSEE) today issued a group of Incidents of Non-Compliance (INC) resulting from the findings of a Panel Investigation into the November 16, 2012 explosion and fire that occurred on a platform operated by Black Elk Energy Offshore Operations. A total of 41 INCs were issued to Black Elk Energy Offshore Operations, Wood Group Production Service Network, Grand Isle Shipyard and Compass Engineering Consultants.
The Panel Investigation Team, comprised of professionals from BSEE and the United States Coast Guard, released its investigative report on November 4, 2013. The Panel conducted a thorough review and found that the fire and exposion was caused by a number of decisions, actions, and failures by Black Elk Energy Offshore Operations and contractors retained by the operator while conducting construction operations. The explosion and fire resulted in the tragic deaths of Ellroy Corporal, Jerome Malagapo, and Avelino Tajonera, serious injuries to others, and the discharge of pollutants into the Gulf of Mexico.
The INCs issued today address violations of specific federal regulations. BSEE's Enforcement Program allows for a 60-day appeal period for INCs. The INCs will also be reviewed for possible assessment of civil penalties. Additional evidence obtained later may reveal further violations which can be considered for enforcement action.
